BARGRAM

Terms & Conditions

Version 1.0 · Effective October 16, 2026

This document is an operational draft structured for attorney review and may be updated with notice.

A. Service Description

BARGRAM is software for liquor inventory management and operational support for bars, restaurants, and hospitality businesses. BARGRAM does not guarantee that inventory records are error-free, complete, or perfectly accurate. Results depend on customer-entered data, calibration accuracy, product setup, staff procedures, weighing accuracy, POS data, integrations, and supplier data.

B. Customer Responsibility

The customer is responsible for:

  • verifying inventory entries and validating weights;
  • maintaining accurate product records;
  • managing staff access to its account;
  • its own physical inventory procedures; and
  • decisions made based on BARGRAM data.

C. No Guarantee of Loss Prevention

BARGRAM may help identify inventory variance and discrepancies. BARGRAM does not guarantee the prevention of theft, loss, shrinkage, employee misconduct, over-pouring, or accounting errors.

D. Subscription

BARGRAM is offered as a recurring monthly subscription under the plan selected at signup. Billing is processed through our payment provider, Stripe. Each subscription begins with a 30-day free trial; after the trial, the selected plan bills automatically each month unless cancelled. You may cancel at any time. If a payment fails, access to certain features may change until billing is updated. Upgrades and downgrades are supported where offered and are prorated by the payment provider. See the Subscription Terms for the current prices and billing disclosures.

E. Trial

New subscriptions include a 30-day free trial. A payment method is required to start the trial. No subscription fee is due at trial start. To avoid the first charge, you must cancel before the trial expires.

F. Cancellation

You can cancel your subscription at any time from the Billing page or through the billing portal. When you cancel, service continues until the end of the already paid billing period, and no further subscription charges are made. Your inventory data is preserved after cancellation.

G. Refunds

Subscription fees are generally non-refundable. Exceptions may be reviewed at BARGRAM's discretion where permitted by applicable law. This policy is a draft subject to company approval.

H. Complimentary Scale

Qualifying new paid subscriptions may include one complimentary promotional scale per qualifying subscription unless otherwise approved. Eligibility, shipping limitations, address responsibility, delivery risks, and replacement review are described in the Scale Shipping Policy. The scale is provided for BARGRAM inventory workflows, and the customer is responsible for its proper use and maintenance. The scale is not represented as certified for legal-for-trade use.

I. BARGRAM Training

BARGRAM Training is educational and operational guidance. Training does not guarantee employee performance, regulatory compliance, profitability, prevention of losses, or specific business outcomes. The customer remains responsible for employee supervision and its own operations. Training scope is defined per engagement.

J. POS & Third-Party Integrations

BARGRAM may integrate with third-party systems. BARGRAM is not responsible for third-party outages, API changes, inaccurate source data, discontinued access, or third-party service interruptions.

K. Availability

BARGRAM does not guarantee uninterrupted service. Maintenance, updates, and temporary service interruptions may occur.

L. Intellectual Property

BARGRAM software, branding, interface, and proprietary technology remain the property of BARGRAM / Growth Intelligence or the applicable owner. The customer retains ownership of its business data, subject to these service terms.

M. Acceptable Use

You may not:

  • use the service unlawfully;
  • attempt to access another business's data;
  • share credentials outside authorized users;
  • reverse engineer the service where legally prohibited;
  • abuse the platform or interfere with its systems or security.

N. Account Security

The customer is responsible for its authorized users and for maintaining reasonable account security.

O. Limitation of Liability

To the maximum extent permitted by applicable law, BARGRAM and its owners, officers, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising from or related to the service. To the extent liability cannot be excluded, BARGRAM's aggregate liability will not exceed the amounts paid by the customer for the service in the twelve (12) months preceding the claim. This section is a draft for attorney review.

P. Indemnification

The customer agrees to indemnify and hold harmless BARGRAM and its owners, officers, and affiliates from claims, damages, and expenses arising from the customer's misuse of the service, violation of these terms, or violation of applicable law, except to the extent caused by BARGRAM's own misconduct. This section is a draft for attorney review.
